<Purposes for which personal data is used>
1. To develop and provide services of genuine value
BRUSH MUSIC runs surveys and research from time to time. These take the form of prize draws or competitions and ask, through your voluntary participation, how you use BRUSH MUSIC and what you think of it. Data including personal data collected through such research and surveys is used by us as material for meeting your expectations more closely, and is also provided to advertisers who sponsor the activity, as notified in advance at the time of the survey. This data is shared with advertisers and partners only in connection with the running of BRUSH MUSIC; we do not provide specific personal data to any third party other than advertisers and partners without your consent. We also use all information, including personal data, voluntarily provided by registered members or guests in order to offer more personalised services and to improve future content based on the interests of registered members and guests.
2. To deliver information related to the services we provide. We produce and supply aggregate reports on the demographics and traffic patterns of registered members and guests for advertisers and for BRUSH MUSIC's partners. These reports let advertisers run more effective advertising, and let registered members and guests receive advertising suited to their needs. Because we do not track the usage patterns of individual registered members or guests, advertisers cannot identify that a particular member or guest clicked on an advertisement.
<Provision to third parties>
We do not provide collected personal data to third parties without your prior consent, except in the following cases.
(1) Where provision to a third party has been notified or published in advance
(2) Where required by law
(3) Where there is imminent danger to life, body or property and an urgent need exists
(4) Where it is necessary to cooperate with a national agency, a local authority or a party entrusted by either in carrying out duties prescribed by law, and
obtaining your consent is likely to impede the performance of those duties
(5) Where disclosure or sharing of information is found necessary in order to provide the products or services you have asked for
(6) Where a company carrying out work entrusted to it by us requires the information in order to provide products or services to you
(7) Where your conduct on the site breaches the terms of use and disclosure is found necessary to protect our rights, property or services
<Notice of purpose when personal data is collected>
BRUSH MUSIC publishes the purpose of use in advance when collecting personal data, except in the following cases.
(1) Where notifying you of, or publishing, the purpose is likely to harm the life, body, property or other rights and interests of you or a third party
(2) Where notifying you of, or publishing, the purpose is likely to harm BRUSH MUSIC's rights or legitimate interests
(3) Where it is necessary to cooperate with a national agency or local authority in carrying out duties prescribed by law, and notifying you of or publishing the purpose is likely to impede the performance of those duties
(4) Where the purpose is clear from the circumstances of collection
<Management of personal data>
Personal data we collect is handled safely and under strict control, in accordance with BRUSH MUSIC's compliance programme.
We may entrust the handling of personal data, as part of a wider engagement, to a company we judge trustworthy and with which we have concluded a confidentiality undertaking. Even then, your personal data remains protected under our compliance programme.
<Publication of matters concerning personal data>
BRUSH MUSIC keeps the following matters concerning personal data available to you and answers your requests without delay.
(1) The purpose for which personal data is used (excluding matters for which the Act on the Protection of Personal Information provides that no such obligation exists.
If we decide not to answer, we notify you to that effect without delay.)
(2) The contact point for enquiries about personal data
<Disclosure of personal data>
Where you request disclosure of your personal data, BRUSH MUSIC discloses it to you without delay.
However, where disclosure would fall under any of the following, we may withhold all or part of it, and
where we decide to withhold, we notify you to that effect without delay.
(1) Where it is likely to harm the life, body, property or other rights and interests of you or a third party
(2) Where it is likely to seriously impede the proper conduct of BRUSH MUSIC's business
(3) Where it would breach other laws or regulations
As a rule we do not disclose information other than personal data, such as access logs.
<Correction of personal data>
BRUSH MUSIC keeps your personal data as accurate and up to date as it can. Where, on the grounds that the data is not true,
you request correction, addition or deletion (together, "correction"), then except where a special procedure is prescribed by law, we carry out the necessary investigation without delay within the scope needed to achieve the purpose of use, make the correction based on the result, and notify you accordingly
<Suspension of use of personal data>
Where you request that use of your personal data be suspended or that it be erased (together, "suspension of use") on the grounds that it is being handled beyond the scope of the purpose published in advance, or that it was obtained by deception or other improper means, BRUSH MUSIC carries out the necessary investigation without delay, suspends use, and notifies you accordingly. However, where suspension would involve substantial cost or is otherwise difficult, and an alternative measure necessary to protect your rights and interests is available, we take that alternative measure instead.
<Use of IP addresses, cookies and web beacons>
